The Regulations on Implementation of Trade Union Law in Guangzhou (hereinafter Regulations) was passed at the 7th session of the 13th Standing Committee of the Guangdong People's Congress held on December 7th. The Regulations will go into effect soon after being approved by the Standing Committee of Guangdong People's Congress. Chen Weiguang, Chairman of Guangzhou's General Trade Union, said at a news briefing that compared with the Trade Union Law of the PRC and Regulations on Implementation of Trade Union Law in Guangdong, the Regulations stipulate detailed rules related to legal liabilities and are easy to understand.
According to Article 7 of the Regulations, persons in charge of business management in a department or an enterprise shall not be appointed as a Chairman or Vice Chairman of the Trade Union. If they want to assume office as Chairman or Vice Chairman, they shall quit their positions as the person in charge of business management. This article, the outstanding one of the Regulations, effectively helps solve conflicts that were formerly caused by a part-time Chairman or Vice Chairman while performing their duties.
According to Article 11, the trade union has the right to represent employees and negotiate with the enterprise or organization on issues related to employees' labor rights. Due to various reasons, pay by negotiation has not turned into reality. So far, an employee's salary has been decided by the employer. Even the trade union has failed to participate completely on issues related to salary.
